Various Causes Of Legal Malpractice

As discussed elsewhere throughout the site, there are various reasons that one can file a lawsuit for legal malpractice.

A Cook County Record article of September 17, 2015, titled “Appeals court upholds dismissal of $14 million legal malpractice case vs. Katten Muchin by heir of Herald Price” highlights come of those causes, including statute of limitations, breach of fiduciary duty, and (legal) actions against an attorney arising from the professional services rendered.

While the case above cites some alleged legal malpractice issues, it should be noted that legal malpractice can take many forms.  Many of these forms are further discussed on this site’s home page.

If you or a family member are concerned that your personal injury legal case may have been mishandled – or that you were in some way misrepresented or “cheated” by your lawyer – please contact Tony Elman, principal trial lawyer at the Elman Law Group, at (773) 392-8182 to further discuss the issue and determine potential solutions.

Illinois Legal Malpractice Case Settled

As further discussed on this site, there are many potential causes of legal malpractice, especially as it pertains to legal malpractice concerning personal injury cases.

There was a recent Illinois lawsuit alleging legal malpractice that has been settled.  The underlying injury case involved injuries sustained on a cruise ship.

The legal malpractice lawsuit is discussed in the July 28, 2015 Madison Record article titled “$5M legal malpractice suit settled for undisclosed amount.”

An excerpt from the article:

According to the complaint, Reinhardt claims she hired the defendants to represent her in a lawsuit she intended to file against a passenger cruise ship on which she allegedly sustained injuries while working in September 1996.

She claims the defendants failed to conduct an accurate investigation into Reinhardt’s injuries and into her employer, the suit states.

“But for defendants’ negligence, lack of due diligence, failure to meet the prevailing standard of care and failure to perform as an attorney knowledgeable on Jones Act issues, plaintiff would not have lost her Jones Act negligence claim against her former employer and would have been entitled to damages including all remedies which the Jones Act negligence complaint against her employer would have afforded her,” the complaint alleges.

Additional details can be seen in various media sources, including the Madison Record article mentioned above.

Legal Malpractice Lawsuit Filed Regarding Personal Injury Case

As discussed elsewhere throughout this website, there are a variety of factors that may be grounds for filing a successful legal malpractice lawsuit.  One such factor is the failure of a lawyer to meet applicable deadlines, including the failure to file a personal injury lawsuit before the expiration of the statute of limitations.  Other such factors are discussed on the Chicago Legal Malpractice Trial Lawyer page.

One example of an alleged missed statute of limitations deadline is seen in a personal injury legal malpractice lawsuit as discussed in The MadisonRecord.com article of June 2, 2015 titled “Legal malpractice lawsuit filed against St. Louis firm over statute of limitations expiration.”

The article describes a lawsuit filed in St. Clair County Circuit court.  The underlying personal injury accident involved a man, James L. Alexander of Belleville, who allegedly fell into a hole dug on his property by the St. Clair County Township Sewer Department.  He hired a legal firm to pursue compensation for his accident injury.

The personal injury legal malpractice claim is discussed within the article.  An excerpt:

Alexander claims he consulted with Abramson and hired him to represent him in a lawsuit against the sewer department, the suit states. However, Alexander alleges Abramson failed to file the action within the one-year statute of limitation.

Additional details and possible updates concerning this Illinois legal malpractice case can be seen in a variety of media sources, including the Madison Record article mentioned above.

Lawsuit Regarding Failure To File Lawsuit On Time

This site discusses the many reasons that one may wish to file an Illinois legal malpractice lawsuit over the mishandling of a personal injury case.  These reasons vary in nature.  Some of the most common reasons are listed on the “Chicago Legal Malpractice Trial Lawyer” page, and are further discussed elsewhere on this site.

The various reasons underpinning legal malpractice are somewhat broad.  One of the most well-known reasons, and one that is often cited in legal malpractice lawsuits, is the failure of a personal injury lawyer (or law firm) to meet deadlines, including the failure of the law firm to file a personal injury lawsuit before the statute of limitations expires.

A recent lawsuit filed in The Circuit Court of Cook County illustrates a law firm that is being sued for the alleged failure to file a lawsuit in time.  The underlying personal injury lawsuit was for an injury suffered when a bus collided with a passenger car in Harvey.

The legal malpractice lawsuit, which alleges a missed statute of limitations, is discussed in the Cook County Record article of November 19, 2014 titled “Woman accuses Slocumb Law Firm of failing to file her lawsuit on time.”

Illinois Legal Malpractice Suit Filed Regarding Medical Malpractice Case

There was a recent Illinois lawsuit filed alleging legal malpractice.  The underlying lawsuit involved a medical malpractice lawsuit.

The legal malpractice lawsuit is discussed in the July 31 Madison Record article titled “Legal malpractice case filed against Rex Carr.”

An excerpt from the article:

Injury lawyer Rex Carr lost a medical malpractice trial he should have won, former client Lisa Comacho alleges in St. Clair County circuit court.

Comacho sued Carr and his firm on July 14, claiming he deviated from the standard of care in pursuing her claim against Belleville neurologist Stephen Burger.

Additional details regarding this Illinois legal malpractice lawsuit – including allegations that Carr failed to present relevant evidence during the medical malpractice trial – can be seen in the Madison Record article mentioned above.  As well, the underlying medical malpractice lawsuit, and allegations of personal injury, is discussed.
