If the statute of limitations for a personal injury or wrongful death case has passed, it is highly unlikely that the case will be allowed to proceed, regardless of its merits. This means that the injured person (or, in the case of wrongful death, the decedent’s relatives) will be unable to receive compensation for injuries and other harm that may have occurred due to the negligence, carelessness, or intentional harm caused by another person or party. This is an extremely unfortunate situation, as there are likely substantial medical costs and other needs for compensation that likely are substantial.
